New York Menacing Cases


Menacing is an extremely serious allegation. The punishments for these crimes in New York can mean years in prison.  If you or a loved one is facing Menacing charges, choosing an attorney to defend your case is one of the most important, if not the most important, decisions you will ever have to make. It is absolutely critical that you retain the services of an aggressive, highly experienced criminal defense attorney with a proven track record as soon as you possibly can.



Menacing is found under New York Penal Law 120.  It ranges in seriousness from Menacing in the Third Degree which is a Class B Misdemeanor, to Menacing in the First Degree, which is a Class E Felony, and carries a possible term of four years in state prison.  You may be charged with menacing if you physically threaten someone, or if you threaten a person with a weapon or dangerous instrument.  Significantly, almost anything may be a dangerous instrument.  It may be a pair of tweezers, a pencil, or a hammer.  Almost anything that has a practical everyday legitimate use, may also be used to harm someone.  Despite the serious nature of Menacing charges, our firm will fully explore the strength of the allegations before recommending a plea of guilty.  In fact, we have sometimes been able to achieve dismissal of these charges without proceeding to trial.  While each case is unique, these results cannot be achieved without a diligent defense strategy.

It should also be noted that many Menacing cases result in the court issuing  an Order of Protection restricting contact between the person charged, and their family.  Sometimes a person is prevented from contacting their children, even when the children were not victims, and were not even present during the incident which triggers the criminal charges.  Violating the order of protection is very serious, and may result in charges of Criminal Contempt which may result in jail time.
