New York Bar Fight Cases

Bar Fights may be extremely serious allegations. The punishments for these crimes in New York can mean years, or decades in prison. If you or a loved one is facing assault charges resulting from bar fights and other altercations, choosing an attorney to defend your case is one of the most important — if not the most important — decisions you will ever have to make. Bar fights are usually charged as Assaults. Assault is defined in New York Penal Law 120.

Assault in the Third Degree found in New York Penal Law 120.00 and is a Class A Misdemeanor which carries a sentence of up to one year in prison. You may be charged with Assault in the Third Degree-Class if you do the following:

1. Intentionally cause a physical injury to another person; or 
2. Recklessly cause a physical injury to another person; or 
3. With criminal negligence cause a physical injury to another with a deadly weapon or a dangerous instrument.

Assault in the Second Degree is found under New York Penal Law 120.05 and is a Class D Felony which carries a sentence of up to seven years. You may be charged with Assault in the Second Degree if you do the following:

1. Intentionally cause a serious physical injury to another person, or

2. Intentionally or Recklessly cause physical injury to another person with a deadly weapon or a dangerous instrument; or

3. Intentionally prevent a police officer or firefighter, or a paramedic or traffic officer from performing a lawful duty, by releasing or failing to control an animal for obstructing lawful; or

4. Intentionally cause unconsciousness or other physical impairment or injury to another person by administering without their consent, a drug or

5. Cause physical injury to a person while committing or fleeing the commission of a felony,

6. Being over eighteen years old and intentionally cause a physical injury or recklessly cause serious physical injury to someone less than eleven years old, or

7. Being over eighteen years old intentionally cause physical injury to a person less than seven years old

8. Cause injury on school grounds to a school employee

9. Injure one of several kinds of public employees including transportation workers.

10. Intentionally cause physical injury to a person who is sixty-five years or older, (Except if the defendant is less than 10 years younger)

Assault in the First Degree is found under New York Penal Law 120.10 and is a Class B Felony which carries a sentence of up to 25 years in prison. You may be charged with Assault in the First Degree if you do the following:

1. Intentionally cause a serious physical injury to another person, with a deadly weapon or a dangerous instrument; or

2. Intentionally cause disfigurement to another person, or

3. Under circumstances evincing a depraved indifference to human life, recklessly engage in conduct which creates a grave risk of death to another person, and cause serious physical injury to another person; or

4. In the course of and in furtherance of the commission or attempted commission of a felony or of immediate flight therefrom, you cause, or another participant causes serious physical injury to a person.

Gang Assault in the Second Degree is found under New York Penal Law 120.06 and is a Class C felony and carries a sentence of up to 15 years in prison. You may be charged with Gang Assault in the Second Degree if you intentionally cause physical injury to another person and when aided by two or more people.

Gang Assault in the First Degree is found under New York Penal Law 120.07 and is a Class B Felony and carries a sentence of up to 25 years in prison. You may be charged with Gang Assault in the First Degree if you intentionally cause a serious physical injury to another person and when aided by two or more other people.

If you have prior felony convictions, you may face a higher sentence.

There are other assault charges under Penal Law 120 if you assault police officers, peace officers, children, day care providers, judges, and certain public employees. You may also be charged with Vehicular Assault if you use a motor vehicle to cause physical injury to another person.

It should also be noted that many assault cases result in the court issuing an Order of Protection restricting contact between the person charged, and their family. Sometimes a person is prevented from contacting their children, even when the children were not victims, and were not even present during the incident which triggers the criminal charges. Violating the order of protection is very serious, and may result in charges of Criminal Contempt which may result in jail time. If you are not a citizen, a conviction may lead to your removal from the United States.
