Elmsford is a Village in the Town of Greenburgh and is a small and diverse community.  The Elmsford Village Court is located at 15 South Stone Avenue in Elmsford New York.  If you have been contacted by the Elmsford Police, or if you have been arrested in the Village of Elmsford, contact our Elmsford Traffic Ticket Defense Lawyers and let us help you preserve your freedom and liberty.

Our Elmsford Traffic Ticket Lawyers are litigators who are in court almost every day.  We usually are handling serious felony cases in New York State and Federal courts, but we also use our litigation experience on behalf of our clients who are facing DWI and vehicle and traffic charges.

Traffic infractions can have a serious and significant effect on your driving privileges and insurance rates. At the Law Offices of Mayo Bartlett PLLC our Elmsford Traffic Ticket Attorneys represent clients who are charged with traffic infractions using assertive and unique strategies to ensure the lowest impact on their driver’s license and to minimize their insurance consequences.

The New York State Vehicle & Traffic Law is constantly changing.  Recent amendments include the imposition of 3 points for the traffic infraction of driving while using a cell phone without a hands free device, or to text and drive.  Westchester courts, including the Elmsford Village Court, can be harsh on drivers depending on what they are charged with.  There are even some Judges who will not reduce speeding tickets.  Our Elmsford Traffic Ticket Lawyers will help you navigate through the Elmsford Village Court to help you get the best possible results

In 2011, New York State instituted the “Move Over Act”, which requires drivers to reduce their speed and to move over one lane if it can be done safely, when they observe an emergency vehicle pulled over to the side of the road. If you are not able to safely pull over you may have a defense if ticketed under the “Move Over Act” since it is also a traffic infraction to make an unsafe lane. A violation of the “Move Over Act” is a three point infraction.

NEW YORK STATE POINT ASSESSMENT SYSTEM

The point system is one way that the New York Department of Motor Vehicles (DMV) may suspend or revoke a driver license. In addition to the point system, there are other mandatory suspensions or revocations as discussed in more detail at our DWI & DUI License Center. If you accumulate three convictions for speeding within 18 months your license will be revoked by the New York State DMV.

In New York State, 11 points on your driver’s license will result in your driver’s license being suspended. Moreover, if you are assessed 6 or more points on your driver’s license in an 18 month period, you will be required to pay a Driver’s Responsibility Assessment, which is a civil penalty imposed by the New York State Department of Motor Vehicles. Failure to pay the assessment will result in your driver’s license, learner’s permit or driving privileges being automatically suspended.

The loss of the ability to drive can be life altering and may affect your personal life and your employment. We will work  help you keep your license, and to prevent your insurance rates from skyrocketing.
