Collateral Consequences of a Conviction

With 3 decades of experience as a Westchester Criminal Lawyer, Mayo is extremely familiar with the collateral consequences that may accompany a criminal conviction.

Collateral Consequences of Criminal Convictions may include, and are not limited to the following:

  1. Loss of your freedom
  2. Loss of your job
  3. Immigration consequences
  4. You may be placed on probation
  5. You may be subjected to random drug testing and be required to undergo drug treatment
  6. You may be ineligible for a professional license
  7. You may lose your Driver License

Our Internet Crime Lawyers have extensive experience in Westchester County Criminal Courts, and are familiar with every aspect of handling Internet Crimes including Child Pornography and other felony and misdemeanor cases from arraignment and bail applications, through motion practice, discovery and trial. We are part of an internet criminal defense team that works frequently with private investigators and forensic experts to provide you with the best child pornography and internet crime defense.

There are increasingly changes to many corporations’ privacy policies which now permit them to share your data with law enforcement if the believe it is criminal in nature. This is particularly true concerning many tech companies. You should know that many transactions which you believe are private may very well not be. It is important to be careful about what information you send or receive over the internet.

It is also possible to be charged for internet crimes you have not committed. For this reason, we suggest that you avoid buying used computers, cell phones, tablets, and other smart devices. Many ordinary devices are essentially computers and may store illicit material without your knowledge. We also suggest that you avoid selling or gifting “smart” devices that you own, since they may have sensitive personal information stored in them. Before you are going to transfer ownership of these devices, we recommend that you wipe their memory prior to the transfer. If you are not comfortable doing so on you own, we suggest that you contact the manufacturer, or a professional who may be able to assist you. Our Internet Crime Defense Attorneys will use our experience in this unique area to offer you professional and diligent representation to help you make the best decision about approaching your defense.

Please be aware that a conviction of a crime, an infraction, or a violation may have significant collateral consequences. For instance, a conviction may lead to fiction from your home, expulsion from school, or loss of your job. You should also know that if you are not a citizen, a conviction may lead to your removal from the United States. Our Internet Crime Defense Lawyers will work with you to help you consider these potential collateral consequences so that you will be able to make the best decision about how to proceed with your case. Occasionally, collateral consequences require an out of the ordinary approach, and we realize that representing clients charged with Internet Crimes is not a one size fits all endeavor.

Internet Crime Cases

Internet Crimes are extremely serious allegations which may include child pornography, grand larceny, forgery and identity theft. The punishments for these crimes in New York can mean years, or decades, and sometimes life in prison. If you or a loved one is facing Internet Crime charges, or charges of identity theft, choosing an attorney to defend your case is one of the most important — if not the most important — decisions you will ever have to make. It is absolutely critical that you retain the services of an aggressive, highly experienced Internet Crime Defense Lawyer with a proven track record as soon as you possibly can.

Internet Crimes are among the most damaging charges a person can face. Often, the allegations alone are enough to damage a person’s life, causing the accused to lose trust, their employment, and even their freedom. It is important to choose an attorney who has experience handling these delicate cases. Our legal team includes forensic experts, private investigators with law enforcement backgrounds, and seasoned attorneys.

If you have prior felony convictions, you may face a higher sentence, which may include life in prison.

Federal Child Pornography charges may subject you to a lengthy prison sentence if you are convicted.

CHILD PORNOGRAPHY CONSEQUENCES

One of the most serious internet crimes is child pornography. If you are convicted of Child Pornography in New York State, you may face consequences that may prove more harmful than jail time. If you are placed on probation, the period of probation may be twice as long as it would normally be, and you may also become a Registered Sex Offender. There are three levels of Sex Offender, and depending on which one you are, you will face an increasing list of restrictions, including, but not limited to the following:

  1. Where you can reside
  2. Where you can work
  3. Whether you can leave the jurisdiction of your probation or parole
  4. Whether to can visit a mall, museum or park
  5. Whether you can continue to reside with your children
  6. Whether you may possess a cell phone
  7. Whether you may possess a computer
  8. Whether you may possess photographs of children
  9. Whether you may drink alcohol
  10. Wether you may continue your education
  11. Whether you may remain in the United States if you are not a citizen

You may be designated a sex offender even if you never had contact with any person. For instance, you may be charged with Disseminating Indecent Material to a Minor in violation of New York Penal Law 235.22 which includes the invitation to a child to engage in sexual intercourse or sending communication which, in whole or in part, depicts or describes, either in words or images actual or simulated nudity, sexual conduct or sado-masochistic abuse, and which is harmful to minors, or Possessing a Sexual Performance by a Child Less than 17 in violation of New York Penal Law 263.15, which includes possessing child pornography. You may become a Registered Sex Offender if you are convicted of either of those crimes.
