A conviction for a Criminal Mischief related offense may have significant collateral consequences including possible expulsion from school, loss of employment, eviction from your home, and possibly even removal from the United States if you are not a citizen. Our New York Criminal Mischief Defense Lawyers will work with you to ensure that your concerns are addressed, including whether you should seek to resolve your case by plea, or go to trial.

Criminal Mischief may also be charged as a hate crime. This may be the case if it involves hate based graffiti, or if the owner of the damaged property was targeted based upon a belief that they belonged to a particular identity group.

Criminal Mischief Cases

Many people are totally unaware that they can be charged with Criminal Mischief in the Fourth Degree, a Class A Misdemeanor and can go to jail for up to one year for damaging the property of another person, damaging abandoned buildings, or for interfering with a person’s attempt to call emergency services, including police and fire fighters.

If you intentionally damage another person’s property that is worth more than $250.00 (possibly an iphone), or if you damage a person’s locked car with intent to steal something, and you have three previous convictions for Criminal Mischief within the previous ten years, you can be charged with Criminal Mischief in the Third Degree, a Class E Felony which carries a maximum of four years in prison.

If the damaged property is worth more than person one thousand five hundred dollars you may be charged with Criminal Mischief in the Second Degree, a Class D Felony which carries a maximum of seven years in prison. Finally, if you use an explosive to damage the property, you may be charged with Criminal Mischief in the First Degree, a Class B Felony which carries a maximum of twenty five years in prison.

It is also important to be aware that if you damage someone else’s property and your actions are perceived to be motivated by hate, you may be charged with a hate crime. This may also be the case if you damage religious premises, or if you draw a swastika, display a noose, or burn a cross. This may not only result in a higher charge, with potentially greater penalties, but it may also result in the prosecutor taking a tougher stance regarding your case.

If you have prior felony convictions, you may face a higher sentence.
