Reckless Driving is found in New York Vehicle and Traffic Law 1212. Although it is not found in the New York Penal Law, it is a misdemeanor and it carries a maximum sentence of 180 days in jail.
New York Vehicle and Traffic Law 1212 states the following:
Reckless Driving shall mean driving or using any motor vehicle, motorcycle or any other vehicle propelled by any power other than muscular power or any appliance or accessory thereof in a manner which unreasonably interferes with the free and proper use of the public highway, or unreasonably endangers users of the public highway. Reckless driving is prohibited. Every person violating this provision shall be guilty of a misdemeanor.
Driving at an excessive rate, not using turn signals, texting while driving, using a cell phone while driving, drinking and driving and weaving in and out of traffic, are just a few of the ways that you may be charged with Reckless Driving. Reckless driving is also a 5 point infraction. More importantly, if someone is injured as a result of your Reckless Driving, you may face additional greater charges, which may include Vehicular Assault or Vehicular Manslaughter.
Be responsible when you drive. Consuming alcohol and Driving While Intoxicated, or smoking Marihuana or using Drugs and Driving While Ability Impaired by Drugs may lead to charges of Reckless Driving.
