It should also be noted that almost all Drug cases are considered “crimes of moral turpitude” for immigration purposes, and may result in removal from the United States if you are not a citizen. In New York, you may be charged with Criminal Sale of a Controlled Substance in the Third Degree, a Class B Felony, which carries a maximum penalty of nine years in prison, for simply handing a narcotic or illegal drug to another person, even if they do not pay you for it. 

You may be charged with Criminal Sale of a Controlled Substance in the First Degree if you knowingly and unlawfully sell:

1. one or more preparations, compounds, mixtures or substances

containing a narcotic drug and the preparations, compounds, mixtures or

substances are of an aggregate weight of two ounces or more; or

2. methadone and the methadone weighs two thousand eight hundred

eighty milligrams or more.

Criminal Sale of a Controlled Substance in the First Degree is a Class A-I Felony, and it carries a maximum sentence of 20 years in prison.

If you have prior felony convictions, you may face a higher sentence.
